1.3 Citizen Participation Law of the Federal District


Another law which is a product of the political reform at the capital of the country at the end of the past decade was the Citizen Participation Law of the Federal District (LPCDF). It must be pointed out that at the federal level there is no law that governs the citizen participation as such. Notwithstanding, for the case of the Federal District, the CPEUM at its article 122, section V, sets forth as authority of the ALDF the legislation on the subject matter of citizen participation. This authority is confirmed by the EGDF on its articles 21 and 42 section XII, reason for which the ALDF has the capacity to create the relevant instruments and mechanisms for the citizens to intake in public issues of the city.

The LPCDF was approved by this instance and published for the first time in December 21, 1998. That is why this law was precursor in the country, for the first time, models of direct participation as the plebiscite, the referendum or the popular bills that were not contained by the CPEUM, were legislated. Following that date, 12 Local Congresses approve laws in such subject matter and in other Local Congress as Michoacán, Oaxaca and Sinaloa bills have been presented in such regard.

The LPCDF in force was published on May 17, 2004 and it has been reformed in six occasions, on January 28, May 16 and July 13, 2005, May 15, 2007, December 30, 2009, and finally on May 27, 2010. On occasion of this last reform, elections for Citizens Committees will be carried out, on October 24, 2010.

The main objective of the LPCDF is to institutionalize and regulate the mechanisms of citizen participation and representation, through which the citizens of the capital participate at the government decisions. These mechanisms are the following:

  1. Plebiscite
  2. Referendum
  3. Popular bills
  4. Citizen Popular Consultation
  5. Citizen Collaboration
  6. Submission of Accounting
  7. Public Diffusion
  8. Network of Citizen Comptrollership
  9. Public Hearings;
  10. Visits of the head of the borough;
  11. Citizen Organizations
  12. Citizen Meeting

In the LPCDF in force, also determines which are the organizations of citizen representation of the territorial units of the Federal District:

I. Citizen Committee

II. Citizen Council

III. Village Council
